1. Purpose
JOOL (“JOOL”) provides a professional short- and mid-term electric-car rental service, accessible to its users (the “Users”) via a web and mobile application compatible with iOS and Android (the “Application”).
These terms of use (the “Terms”) define the conditions for accessing the services offered on the Application (the “Services”), as well as the rights and obligations of the Users in this context.
The Terms are accessible and printable at any time via a link at the bottom of the page at https://www.jool.co/terms-and-conditions (the “Site”) and from the Application. They may, where applicable, be supplemented by specific terms of use applicable to certain Services, which supplement the Terms and, in case of contradiction, prevail over them.
2. Definitions
Personal Space: space accessible on the Application by any User upon creation of their account, allowing them in particular to manage their use of the Services.
User: any natural person wishing to rent a car through the Application.
3. Conditions for accessing the Services
The Application and the Services are accessible:
- to any natural person with full legal capacity to commit to the Terms. A natural person who does not have full legal capacity may access the Application and the Services only with the agreement of their legal representative;
- to any legal entity acting through a natural person with the authority or capacity required to contract on behalf of the User.
The User has the status of:
- consumer, defined as any natural person acting for purposes that do not fall within their professional activity; or
- professional, defined as any natural or legal person acting for purposes within their commercial, industrial, craft, professional or agricultural activity and holding the necessary authorisations to carry out their activity.
The User is also required to hold a valid driving licence held for more than 5 years to access the Services, with no current suspension.
4. Acceptance of the Terms
Acceptance of the Terms by Users is materialised by a check box on the Site or the Application.
Acceptance can only be full and complete. Any partial acceptance is considered null and void.
A User who does not accept being bound by the Terms must not access the Application or the Services.
The Terms exclusively govern the relationships between JOOL and the Users.
5. Registration
5.1. Registration request
To access the Services, the User must fill in the registration form available on the Application, providing in particular:
- a valid mobile phone number;
- a valid email address to which they alone have access;
- their first name, last name and date of birth as they appear on their driving licence (if they hold one) and on any identity document (passport, ID card, proof of address).
Any incomplete registration request cannot be validated.
A front/back photograph of the driving licence and a profile picture are required from the User for the first rental made through the Application.
The User warrants that all information provided in the registration form is accurate, up-to-date and truthful and is not misleading in any way.
The User undertakes to update their information in their Personal Space on the Application in case of changes, so that it always matches the above criteria.
The User is informed and accepts that the information entered for the purpose of their registration constitutes proof of their identity. It binds them upon validation.
JOOL reserves the right to carry out any necessary additional verification and in particular to request, by any means (including by email or SMS), any additional identity document or proof to attest to the accuracy of the information provided.
JOOL reserves the right to close, suspend or block access to the Account, the Site, the Application and the Services for any User who has provided, voluntarily or involuntarily, false or inaccurate information about their identity. The User shall then not be entitled to any refund of reservations made on the Site or the Application.
5.2. Account creation
The registration request triggers the creation of an “Account” in the User’s name, giving them access to a Personal Space that allows them to manage their use of the Services.
The Account will be fully activated upon validation of the registration request, JOOL reserving the right to refuse any request at its discretion and without having to justify the reason.
It is expressly forbidden for the User to create or use multiple Accounts. JOOL reserves the right to delete without notice any additional Account identified as belonging to the same User.
The User undertakes to use the Services personally and to not allow any third party to use them on their behalf, unless they take full responsibility for it.
They must immediately contact JOOL at the details provided on the first page of the Terms if they notice that their Account has been used without their knowledge. They acknowledge JOOL’s right to take any appropriate measures in such a case.
6. Description of the Services
The User has access to the following Services, in a form and according to the features and technical means JOOL deems most appropriate, as described on the Site and the Application.
6.1. Car search
JOOL allows the User to consult and book a car offered on the Application or the Site, based on their needs and search criteria.
The display of available cars is entirely managed by JOOL. The order in which results are presented may vary depending on several parameters, such as the match with the criteria entered by the User (dates, pick-up location, number of passengers, etc.) and the effective availability of the cars.
6.2. Car rental
Once they have selected the car they wish to rent, the User can submit a rental request, according to the terms set out in section 7.1.
Before proceeding with payment, the User is informed:
- that a deposit of €1,000 is required:
- for rentals of less than 3 months, this deposit is pre-authorised on the User’s bank card 3 days before the rental start date;
- for rentals of more than 3 months, the deposit is charged on the User’s bank card 3 days before the rental start date, then returned at the end of the rental, subject to no outstanding amounts;
- that they take out comprehensive insurance with a €1,000 excess (reduced to €500 excess for glass breakage).
Every rental is associated with a “Delivery” service to make the relevant car available, and a “Pickup” service at the end of the rental. Every Delivery and Pickup is defined by a date, time and address provided by the User during their search on the Site or the Application. In order to provide the best service quality for Delivery without hindering traffic near the address provided, JOOL will park the car on the street within a 500-metre radius of the address provided by the User.
JOOL does its best to deliver the car to the address and time provided. However, it cannot be held responsible for any Delivery delay caused by traffic events outside its full control (congestion, accidents, roadworks, traffic-regulated zones for an event or demonstration, temporary traffic bans, etc.).
JOOL reserves the right to refuse a Delivery or Pickup if the address or time provided does not allow it to provide a satisfactory Service (inaccessible area, night-time, planned event at the indicated time and location).
For the Return, the User undertakes to park the car on a public, authorised spot at the address provided at the time of booking or within 500 metres of that address. The User remains responsible for the car and for any damage or fine until the indicated end-of-rental time, even if they wish to return it earlier. No refund is possible in case of early return.
Once the rental is over, the User must end the rental in the Jool application.
If the car is not returned within 500 metres of the indicated address, the User is exposed to penalties as described below.
6.3. Charging and battery
For the smooth running of the rental, JOOL undertakes to provide a car with a minimum 70% charge at the start of the rental.
The User undertakes to return the car with a minimum 10% charge at the end of the rental. If the level is below 10% at return, the User undertakes to pay all towing fees and any repairs that may be linked to a complete discharge of the car’s battery.
The cars rented through JOOL may be configured with automatic charging services, in particular on the Tesla and Electra supercharger networks. If a charge is performed by the User on one of these networks during the rental and no payment is requested from the User, the User will be re-billed at actual cost at the end of the rental. The User may of course, throughout the duration of the rental, charge the car on the networks of their choice (including home network, Ionity, Shell, Total Energies, Lidl, Fastned, Belib, etc.), in which case the User is free to use the payment method of their choice (bank card, app, badge) without Jool’s involvement. The User cannot claim any refund from Jool for a charge paid for by them, for any reason.
The User undertakes to vacate any dedicated charging spot once their charge is complete or if the car is not charging. If the car occupies a spot associated with a charging station without justification, the User may be billed occupancy fees.
6.4. Trip planning
The car search on the Site or the Application may be accompanied by a trip plan corresponding to the route between the Delivery address and the destination address entered by the User during their booking (the “Planning”).
Any Planning displayed on the Site or the Application or shared by any means (including email or SMS) with the User is provided for information only. It does not guarantee the availability or operation of charging stations along the route and cannot be the subject of any claim. The Planning of the battery state along a route does not guarantee the car’s operation either, as consumption will depend in particular on weather conditions during the trip, the User’s driving style and actual traffic.
During the rental, the User undertakes to use and follow the recommendations of the trip planner built into the rented car’s software. If this information contradicts the information previously displayed by the Site or Application’s trip planner, the information displayed by the car’s software must be followed.
6.5. Lateness
JOOL will charge the User €25 incl. VAT for each hour of lateness started, up to a maximum of 6 hours.
Any lateness leading to a return after 11:30 pm will be counted as 6 hours of lateness. After 6 hours of lateness, the User will no longer have access to the car.
JOOL grants the User 15 minutes of unbilled lateness.
To end the rental, the User must end the rental in the JOOL application. Otherwise the rental is considered to be still ongoing. The User may then be billed late fees as described above.
6.6. Return to another address
If the car is not returned to the Return address or more than 500 metres from it, the User will be liable for all car-recovery fees, which may be deducted from their deposit.
The User is expressly informed and accepts that they may owe an amount higher than the deposit if the latter is insufficient.
6.7. Damage
The User expressly acknowledges and accepts that, in the event of damage to the car upon return, they will be liable for the total cost of the repairs resulting from damage caused during the rental period. A price grid available at www.jool.co/damage indicates the indicative repair fees.
The rental period begins and ends at the times agreed at booking. If the Lessee decides to pick up the car after the start time, or to return it before the end time, any damage occurring while the vehicle is parked remains their responsibility and the associated repairs will be charged to them.
6.8. Cleaning
Cars are made available by JOOL in a satisfactory state of internal and external cleanliness. The User cannot claim any compensation or refund if the cleanliness state does not suit them. The car may, in particular, be moderately dirty on the outside due to events that occurred during Delivery, without the User being entitled to any compensation.
The car must be returned in a state of cleanliness consistent with normal use.
External and internal cleaning of the car is included in the price of each rental. Any abnormal dirt:
- inside, including the presence of mud, animal hair, debris, sticky or odorous textures;
- outside, including the presence of mud, bird droppings, pollen, sand, sticky textures (resin),
may be charged at a total amount of €50 incl. VAT (€25 incl. VAT for the inside, €25 incl. VAT for the outside), deducted from the User’s deposit.
Any element missing compared to what was present at Delivery (toll-tag holder, phone holder, charger, sticker or any other element) may be charged at €30 incl. VAT deducted from the User’s deposit.
6.9. Fines and parking notices
The User will be liable for the amount, plus a €15 incl. VAT processing fee, of any fine, fixed penalty, post-parking fee (FPS), tow-yard recovery fees or any other amount linked to non-compliance with traffic or parking rules.
If JOOL receives a Post-Parking Fee (FPS) or any other payment notice linked to a parking violation, corresponding to the effective period during which the car was rented by the User, the User acknowledges full responsibility for the amount due.
In accordance with Article L. 121-2 of the French Road Traffic Code, the lessee is liable for offences committed during the period the car was made available.
Accordingly, JOOL reserves the right to automatically debit the FPS amount directly from the payment method registered by the User at booking, without prior agreement.
The User may not contest any fine received during the rental period and agrees that their identity will be transmitted to the competent authorities.
6.10. Inspection reports
Before the start of the rental, an inspection report at the start of the rental will be sent by email to the User. This document attests to the condition of the car before the rental. The User may, before starting their rental, send additional photographs or comments to dispute these reports.
An end-of-rental inspection report will be carried out by JOOL within 48 hours of the end of the rental. This check makes it possible to verify that the car has not suffered any damage during the rental.
An email will then be sent by JOOL to the User with an end-of-rental report attached, certifying the presence or absence of any damage noted.
The User accepts that this end-of-rental report communicated by JOOL is authoritative.
6.11. Insurance
The rental price includes comprehensive insurance that covers, in particular, the following:
- third-party liability / defence and recourse;
- automobile civil liability (compensation for damages caused to third parties by the car);
- bodily injury;
- consequential material and immaterial damage;
- environmental liability;
- damage to the car and/or its contents;
- weather events;
- natural disasters;
- theft or attempted theft;
- vandalism;
- fire;
- electrical damage;
- collision, overturning, parking impact;
- terrorist attacks, riots, civil disturbances;
- glass breakage.
In the event of material damage to the car, the User remains liable for €1,000 as excess (reduced to €500 excess for glass breakage).
If, after the insurance’s review of the claim, a third party is identified and bears responsibility for the claim, JOOL will return the €1,000 excess to the User. As insurance processing times vary, this amount may be held for up to 6 months.
Any no-fault claim without an identified third party automatically triggers the deduction of the full €1,000 excess.
The insurance does not cover the loss, disappearance or theft of luggage, personal effects or any other items carried in the rented car.
6.12. Technical support
For any question related to the use of the Application, JOOL provides a technical support service accessible at support@jool.co or through the Application.
6.13. Car maintenance
For any rental longer than 3 months, JOOL covers the financing of routine maintenance for the vehicle made available to the User, within the scope of normal use.
The following are included:
- replacement of consumables (tyres, windshield-washer fluid, wipers, filters, etc.) when their wear is linked to standard use of the vehicle;
- periodic services as scheduled by the manufacturer, if they fall during the rental period;
- mandatory technical inspections, where applicable.
JOOL will inform the User of upcoming maintenance operations and organise interventions either via:
- a partner centre;
- a mobile workshop (if compatible with the intervention and the relevant vehicle).
In case of damage linked to a manifest lack of care or negligence (tyres damaged by abusive driving, ignoring a pressure warning, empty or clogged reservoirs, deliberate or repeated damage to the wipers, etc.), repair or replacement costs will be fully charged to the User, applying the rates set out in the grid available at www.jool.co/damage.
6.14. Other Services
JOOL reserves the right to offer any other Service it deems useful, in a form, according to the features and technical means it considers most appropriate to deliver such Services.
6.15. Geographic area in which the Services can be used
The User is authorised to use the car rented via the JOOL Application throughout the member countries of the Schengen Area, including the European Union member states as well as Switzerland and Norway. The Schengen Area refers to a free-circulation area regrouping countries that have abolished internal border controls. A complete and up-to-date list of member countries is available on the European Union’s website. At the date of these Terms, it includes in particular: Germany, Austria, Belgium, Denmark, Spain, Finland, France, Greece, Hungary, Italy, Luxembourg, the Netherlands, Poland, Portugal, the Czech Republic, Slovakia, Slovenia, Sweden, Norway, Iceland and Liechtenstein.
The User undertakes to comply with the laws and regulations in force in each country crossed, in particular regarding driving, parking and automobile insurance. They are responsible for ensuring the car is used in accordance with these legal provisions and these Terms.
Any departure from French territory must be reported to JOOL at the time of booking, in order to check the compatibility of the car and insurance coverage with the destination country. Certain geographic limitations may apply depending on the selected car or the situation in the country visited. The following are notably not authorised: Morocco, Tunisia, Algeria, Turkey, Russia, Ukraine, Belarus, Iran, Iraq, Israel, the United Arab Emirates and generally any country located outside continental Europe or subject to security or insurance restrictions.
The User remains responsible for any offence, damage, immobilisation or additional costs occurring abroad during the rental period.
6.16. Assistance in case of car immobilisation
Jool assistance is available 7 days a week in cases leading to immobilisation of the car, making its use impossible or inappropriate in accordance with the Road Traffic Code, as a result of one of the following events:
- a traffic accident preventing use of the car;
- a mechanical, electrical or electronic breakdown, excluding lack of maintenance by the customer, making the car unusable;
- puncture or tyre blow-out;
- attempted theft or vandalism preventing use of the car;
- theft, fire or weather event making the car unusable.
The following are expressly excluded from coverage:
- interventions on non-driveable roads/tracks;
- driving under the influence of alcohol, drugs or without a valid licence;
- damage resulting from intentional or fraudulent fault of the Lessee;
- car used for purposes not authorised by the Terms (paid transport of people or goods, driving outside authorised circulation areas, etc.);
- force majeure;
- costs incurred without Jool’s prior agreement.
Services included:
- Breakdown / towing: actual costs up to the garage indicated by Jool or its provider;
- Customer accommodation: up to €150 incl. VAT per night per person, with a limit of 2 consecutive nights if the car cannot be repaired or recovered on the same day. Not combinable with the “Return home” service;
- Immediate mobility: up to €100 incl. VAT per event. Taxi/replacement car for an urgent trip;
- Return home: one-way transport, up to €100 incl. VAT per person organised by the assistance, if the car is immobilised for more than 24 hours or if a stolen car is not recovered within 24 hours. Not combinable with the “Customer accommodation” service.
Assistance services are granted exclusively during the rental period and apply only to covered events occurring in metropolitan France. Jool cannot be held responsible for setbacks, faults or shortcomings attributable to force-majeure events, intervention by local emergency services, administrative decisions or any fact outside its direct control. The User or their relatives must, in case of emergency, contact local emergency services directly and as a priority.
Jool cannot in any case substitute itself for local emergency services, nor cover the costs thereby incurred. The coverage caps mentioned above are maximum amounts per event. Any expense not pre-validated by Jool or its assistance remains the User’s responsibility. Costs incurred will be reimbursed upon presentation of original receipts, within the limit of those Jool would have incurred to organise the service.
Jool will not be held responsible for breaches or delays in performing its obligations resulting from force-majeure events or events such as civil or foreign war, revolution, notorious political instability, reprisals, embargoes, economic sanctions, civil disturbances, riots, strikes, seizures by public authorities, official prohibitions, piracy, ordnance explosions, nuclear or radioactive effects, natural disasters.
Jool cannot be held responsible for loss of enjoyment, indirect losses or any consequence other than costs directly related to the assistance.
7. Financial conditions
7.1. Rental price
The total applicable rental price is the one displayed on the Application on the day of the rental request by the User. This price is determined in particular by the duration of the desired rental.
The following services are included in the price paid on the Site or Application:
- car delivery and pickup;
- comprehensive insurance;
- cleaning;
- kilometre allowance indicated at booking.
Unless otherwise stated, the price is given in euros.
The User is expressly informed and accepts that only payment of the full price validates the rental and triggers the booking of the car on the agreed dates.
7.2. Mileage
At the end of the rental, the exact number of kilometres driven by the User is calculated from the car’s odometer.
The rental includes a kilometre allowance specified at booking (included km). The User may, before the rental, add an additional kilometre allowance of their choice at the rate indicated at booking (added km). If the User exceeds this allowance, JOOL will charge an amount m = n × p, where n = the number of additional kilometres driven and p = the per-kilometre rate indicated at the time of booking the car (additional km).
7.3. Occupancy fees
Any fine, occupancy fee or tow-yard recovery fee linked to unjustified occupation of a charging spot (in particular if the battery is at 100% or the car is not charging) will be billed to the User at the actual amount plus a €15 incl. VAT processing fee.
7.4. Tolls
When the User takes a route that includes free-flow toll sections, the amount corresponding to the toll is paid directly by Jool. At the end of the rental, the same amount is billed, without additional fees, to the User and deducted from their deposit.
The User acknowledges and accepts that all costs linked to the use of free-flow tolls will be charged to them.
7.5. Payment terms
7.5.1. Short-term rental
The rental price is paid by the User by Apple Pay or bank card, through the secure payment provider indicated on the Application or Site, which alone keeps their banking details and whose terms of use they accept.
7.5.2. Mid-term rental
The User is charged monthly by JOOL for the provision of its Services. The first month of rental is paid by bank card at the time of booking, via the Application or Site, through the secure payment provider indicated, which alone keeps their banking details and whose terms of use they accept.
As of the second month of rental, JOOL carries out two separate debits each month on the bank card registered by the User:
(i) Fixed monthly instalment. The fixed amount of the monthly instalment, due for the coming month, is automatically debited three (3) days before the anniversary date of the car’s Delivery.
(ii) Additional fees. The additional fees linked to the past month, in particular:
- additional kilometres driven by the User during the past month;
- charging fees advanced by JOOL;
- free-flow tolls paid by JOOL;
- any unjustified charging-station occupancy fees or tow-yard fees;
- any other sums due under these General Terms and Conditions,
are automatically debited, in arrears, on the anniversary date of the car’s Delivery.
In the event of failure to collect the fixed monthly instalment (in particular insufficient funds, opposition, limit exceeded, expired card or bank rejection), the User has the three (3) days separating them from the anniversary date to regularise their situation, by any means accepted by JOOL.
Failing full payment of the fixed monthly instalment by the anniversary date of the Delivery, and by operation of law, without any prior formal notice being required:
- the car is remotely immobilised by telematic means, making any use impossible until full regularisation;
- the rental contract is suspended, without such suspension giving rise to any rent reduction nor extending the subscribed commitment period;
- the deposit is retained as a precautionary measure and will not be returned until the situation is regularised, without prejudice to its allocation against the sums due in accordance with article 7.6.
In the event of failure to collect the additional fees on the anniversary date of the Delivery, the User has a period of seven (7) calendar days from that date to regularise their situation, in particular by topping up the registered bank card or by providing JOOL with a valid means of payment.
Failing full payment at the end of this seven (7) day period, and by operation of law, without any prior formal notice being required:
- the car is remotely immobilised by telematic means, making any use impossible until full regularisation;
- the rental contract is suspended, without such suspension giving rise to any rent reduction nor extending the subscribed commitment period;
- the deposit is retained as a precautionary measure and will not be returned until the situation is regularised, without prejudice to its allocation against the sums due in accordance with article 7.6.
In the event of persistent non-payment, the provisions of article 14 (Liability in the event of non-payment or non-return) apply in addition to the measures above, in particular as regards the declaration of non-return, daily late fees and the initiation of proceedings.
7.6. Deposit
When validating the rental and to finalise the booking of a car, the User must grant the payment provider, on behalf of JOOL, an authorisation to debit a deposit of €1,000.
The duration of the deposit authorisation must be at least 30 days. If the authorisation is shorter than 30 days, the User must grant the deposit authorisation with another payment method or authorise that this amount be debited by the payment provider, on behalf of JOOL, for the estimated duration required.
The User expressly authorises JOOL to deduct from this deposit the amounts they will owe, in particular:
- fees linked to the actual number of kilometres driven with the rented car;
- free-flow toll usage fees;
- charging fees on the Tesla and Electra network stations;
- unjustified charging-station occupancy fees;
- fees for returning the car to a different address than the one indicated at the time of rental;
- additional rental fees resulting from late return of the car;
- additional rental fees relating to extending the rental;
- additional fees resulting from any damage to the car;
- additional cleaning fees for the car;
- fine-processing fees;
- the excess in case of damage, theft or fire of the car, as provided by the insurance policy.
These fees are detailed on the Site at www.jool.co/damage.
8. Cancellation and modification of the rental
8.1. Short-term rental
8.1.1. Cancellation of the rental
The User may cancel the rental by contacting JOOL on its WhatsApp account (+33 7 44 09 78 95), or by emailing support@jool.co within a maximum of 72 hours before the start date and time of the rental.
The User will be refunded the rental price of the car within 10 days following notification of the cancellation.
No refund request can be accepted after that deadline.
8.1.2. Modification of the rental before the start of the rental
Within a maximum of 72 hours before the start date and time of the rental, the User may request to modify the rental dates by contacting JOOL on WhatsApp (+33 7 44 09 78 95), or by emailing support@jool.co. Fees corresponding to the extension duration may be charged to the User. If the rental duration is shorter, the User may benefit from a credit on a future rental.
8.1.3. Modification of the rental after the start of the rental
During their rental, the User may extend their rental directly in the Jool application. Extension will only be possible if the car is available on the requested dates. Fees corresponding to the extension duration will be charged to the User. The extension is only possible up to 2 hours before the end of the rental.
In case of early return of the car compared to the originally agreed return date, no refund will be made.
8.2. Mid-term rental
8.2.1. Cancellation of the rental
The User may cancel the rental by contacting JOOL on its WhatsApp account (+33 7 44 09 78 95), or by emailing support@jool.co within a maximum of 72 hours before the start date and time of the rental.
The User will be refunded the rental price of the car within 10 days following notification of the cancellation.
No refund request can be accepted after that deadline. After the cancellation deadline, the User is fully committed for the entire commitment period chosen at booking (3, 6 or 12 months).
No early disengagement will be accepted outside the cases expressly provided for in these Terms.
Accordingly, the User remains liable for all remaining monthly instalments until the end of the commitment period, even in case of early return of the vehicle or discontinued use.
8.2.2. Rental extension
At the end of the commitment period, the rental is tacitly renewed under the same conditions for the following month. If the Lessee does not wish to extend the rental for an additional month, they must inform JOOL by email at support@jool.co or by WhatsApp at +33 7 44 09 78 95, observing a 15-day notice period.
8.2.3. Claim and immobilisation of the car during the commitment period
In case of accident, claim, breakdown, theft, damage or any other event causing temporary or permanent immobilisation of the car during the commitment period of a mid-term rental, regardless of the cause (attributable to the User, an identified or unidentified third party, or resulting from force majeure), the User remains liable for all monthly instalments until the end of the commitment period chosen at booking (3, 6 or 12 months). JOOL is under no obligation to provide the User with a replacement vehicle, whether the immobilisation is temporary (immobilisation for repair, expert assessment, or any other cause) or permanent (car declared economically irreparable, stolen and not recovered, or destroyed).
The provisions of Article 6.16 on immobilisation assistance remain applicable within the limits and caps provided therein; they cannot in any case be interpreted as an obligation to provide a mobility solution for the remaining commitment period. The excesses, fees and indemnities linked to a claim, as provided in Article 6.11, remain due by the User under the conditions provided therein, regardless of the continuation of monthly instalments.
In case of permanent immobilisation of the car before the end of the commitment period, JOOL may, at its sole discretion and without the User being able to claim it as a right, propose either to make another vehicle available until the end of the commitment, or to terminate the contract early.
9. Express waiver of the right of withdrawal
Users who qualify as consumers are informed that a right of withdrawal in principle applies to service contracts concluded at a distance between a professional and a consumer, this right being exercisable within 14 days from the conclusion of the contract. They are expressly informed and accept that the Services are provided to them as soon as a rental is booked and are thus fully performed before the end of the withdrawal period mentioned above. Consequently, they expressly waive their right of withdrawal, which therefore cannot be exercised, in accordance with Article L.121-21-8 of the French Consumer Code.
10. Users’ obligations
Users undertake, in their use of the Services, to comply with the laws and regulations in force and not to infringe the rights of third parties or public order.
They are expressly informed and accept that their personal belongings remain under their sole responsibility.
JOOL disclaims any liability in case of loss or oversight of these belongings in any of the cars rented through the Application or the Site.
Users acknowledge having read on the Site and the Application the characteristics and constraints, including technical constraints, of all the Services.
They are solely responsible for their use of the Services.
Users undertake to provide JOOL with all the information necessary for the proper performance of the Services and, in particular, to inform it of any difficulty or claim related to the Services.
More generally, Users undertake to actively cooperate with JOOL with a view to the proper performance of the Services.
11. User’s warranty
The User warrants JOOL against all complaints, claims, actions and/or demands that JOOL could suffer as a result of the User’s breach of any of their obligations or warranties under the Terms.
The User undertakes to indemnify JOOL for any prejudice it may suffer and to pay it all fees, charges and/or convictions it may have to bear as a result.
12. Prohibited behaviour
The lessee undertakes to use the vehicle as a reasonable person and expressly refrains, throughout the duration of the rental, from: (i) carrying out or having carried out any modification, transformation or personalisation of the vehicle, whether mechanical, software or aesthetic (except for official software updates from the manufacturer); (ii) installing, fixing or introducing any additional equipment, accessory or device in or on the vehicle (homelink, additional screen, spoiler) without the prior written consent of the lessor; (iii) directly contacting the customer service or technical support of the manufacturer for any reason related to the rented vehicle. Any request related to the vehicle must be addressed exclusively to the lessor. In case of breach of any of these obligations, the lessee will be liable for all damages, costs and prejudice resulting therefrom, and the lessor reserves the right to terminate the rental without notice or refund.
It is strictly forbidden to use the Services for the following purposes:
- carrying out illegal or fraudulent activities or activities that infringe the rights or safety of third parties;
- paid transport of persons;
- transport of goods on behalf of others;
- short-term car rental (subletting);
- driving instruction;
- international transport outside the Schengen Area;
- transport of dangerous materials;
- breaching public order or violating the laws and regulations in force;
- intruding into a third party’s computer system or any activity likely to harm, control, interfere with, or intercept all or part of a third party’s computer system, violate its integrity or security;
- sending unsolicited emails and/or prospecting or commercial solicitations;
- manipulations aimed at improving the search-engine ranking of a third-party site;
- helping or inciting, in any form and in any way whatsoever, one or more of the acts and activities described above;
- and more generally any practice that diverts the Services from purposes other than those for which they were designed.
It is strictly forbidden for Users to copy and/or divert for their own purposes or those of third parties the concept, technologies or any other element of the Site and the Application.
The following are also strictly forbidden: (i) any behaviour likely to interrupt, suspend, slow down or prevent the continuity of the Services; (ii) any intrusion or attempted intrusion into JOOL’s systems; (iii) any diversion of the system resources of the Site and the Application; (iv) any actions of a nature to impose a disproportionate load on their infrastructure; (v) any breach of security and authentication measures; (vi) any acts likely to harm the financial, commercial or moral rights and interests of JOOL or the users of its Site and Application; and more generally (vii) any breach of the Terms.
It is strictly forbidden to monetise, sell or grant all or part of the access to the Services or the Application, or to the information hosted and/or shared there.
13. Sanctions for breaches
13.1. In case of breach of any of the provisions of the Terms or, more generally, infringement of the laws and regulations in force (including a significant number of road-traffic offences, repeated failure to pay for parking, or multiple obstructive parking instances) by a User, JOOL reserves the right to take any appropriate measure, in particular to:
- suspend, delete or prevent access to the Services of the User who is the author of the breach or infringement, or who has participated therein;
- delete any content uploaded on the Application;
- publish on the Site or Application any information message JOOL deems useful;
- alert any relevant authority;
- initiate any legal action.
13.2. In case of breach by a User of an essential obligation under the Terms, JOOL reserves the right to delete their Account, with immediate effect. The termination takes effect as of right on the date the written notice is sent by JOOL to the User pursuant to this clause.
14. Liability in case of non-payment or non-return
In case of non-payment of all or part of the amounts due on the due date, or in case of non-return of the vehicle on the agreed end-of-rental date, JOOL will automatically and without notice take the following measures:
- remote blocking of the vehicle via telematics, making any use impossible until the situation is fully remedied;
- declaration of non-return of the vehicle to the competent authorities and initiation of legal proceedings;
- triggering of the full deposit, as compensation for the amounts owed, contractual penalties, costs incurred and immobilisation of the vehicle.
Fixed fees may be levied for this, in particular:
- vehicle-recovery fees up to:
- €1,000 incl. VAT if the vehicle is located in France;
- €2,000 incl. VAT if the vehicle is located in an authorised foreign country.
- daily fees applied from the day following the planned return date, including:
- the daily rental amount pro-rated to the usual monthly rate;
- a late-return penalty of €50 incl. VAT per day of delay, intended to cover management and immobilisation costs.
The User is expressly informed that these amounts may be deducted from their deposit without prior notice. If the latter is insufficient, the User remains liable for the entire remaining balance, which may be subject to recovery proceedings.
15. JOOL’s obligations
JOOL undertakes to provide the Services diligently and according to the rules of the art, it being specified that it is subject to a best-effort obligation, to the exclusion of any obligation of result, which the Users acknowledge and expressly accept.
JOOL undertakes to make its best efforts to honour any car rental concluded through the Application, subject to availability, and to provide the User with all the information necessary to take charge of the car.
In a constant effort to improve the quality of the Services, JOOL invites Users to share any comments and information they wish to bring to its attention concerning the quality of the Services.
JOOL undertakes to regularly carry out checks to verify the operation and accessibility of the Site and the Application. As such, JOOL reserves the right to temporarily interrupt access to the Application or the Site for maintenance reasons. Similarly, JOOL cannot be held responsible for momentary difficulties or impossibilities of accessing the Application due to external circumstances, force majeure, disruptions of telecommunication networks, or a malfunction of the User’s smartphone.
The User is informed and accepts that the implementation of the Services requires them to be connected to the internet, and that the quality of the Services depends directly on this connection, for which they are solely responsible. JOOL does not guarantee to Users (i) that the Services, subject to constant research to improve their performance and progress, will be totally free of errors, vices or defects, (ii) that the Services, being standard and not offered for the sole intention of a given User based on their own personal constraints, will specifically meet their needs and expectations.
In any case, the liability that may be incurred by JOOL under these Terms is expressly limited to the direct, proven damages suffered by the User.
16. JOOL’s intellectual property
The systems, software, structures, infrastructures, databases and content of any kind (text, images, visuals, music, logos, trademarks, databases, etc.) operated by JOOL within the Site and the Application are protected by all intellectual-property rights or database-producer rights in force. All disassembly, decompilation, decryption, extraction, reuse, copying and more generally any acts of reproduction, representation, broadcasting and use of any of these elements, in whole or in part, without JOOL’s authorisation, are strictly forbidden and may be subject to legal proceedings.
The User benefits under these Terms only from a licence to use the Application and the elements transmitted by JOOL for the duration of their registration on the Application.
17. Personal data
JOOL implements a personal-data protection policy whose features are explained in the document titled “Privacy policy”, accessible on the Site and the Application, and which the User is expressly invited to read.
18. Advertising
JOOL reserves the right to insert on any page of the Site and the Application any advertising or promotional messages in a form and under conditions of which JOOL will be the sole judge.
19. Account deletion
The User may request deletion of their Account via a link accessible in their Personal Space.
20. Modifications
JOOL reserves the right to modify its Terms at any time. The User will be informed of these modifications by any useful means with one month’s notice. If they do not accept the modified Terms, they can unsubscribe from the Services. Any registered User who uses the Services after the entry into force of the modified Terms, without having expressed to JOOL their refusal to apply them, is deemed to have accepted them.
21. Language
In the event of a translation of the Terms into one or more languages, the language of interpretation will be French in case of contradiction or dispute regarding the meaning of a term or provision.
22. Consumer mediator
In case of dispute with JOOL, the User agrees to use consumer mediation before initiating any legal proceedings. This amicable process under the French Consumer Code is free of charge for the User.

The use of mediation aims at finding an amicable, fast and free solution before any potential court proceedings.
23. Applicable law and jurisdiction
The Terms are governed by French law. In case of dispute between the User and Jool, and failing an amicable agreement within one month following the first notification of the dispute, the dispute will be submitted to the exclusive jurisdiction of the courts of Paris (France), except for mandatory provisions to the contrary outside the Schengen Area.
